Hindu Marriage Act on Divorce Amendment Approved by Cabinet
An amendment in the Hindu Marriage Act 1955 and Special Marriage Act 1954 was agreed by the Union Cabinet, headed by Prime Minister Manmohan Singh, on Thursday.
It was informed by the Minister for Information and Broadcasting Minister, Ambika Soni after the meeting that amendment allows divorce in a couple witnessing severe differences.
She said that the altered act will help reducing harassment as it will now be made sure that divorce is finalized only after mutual consent.
The amended bill will ensure the protection to both the parties to marriage who file a petition for grant of a divorce, even in the case when one party purposely does not attend the court hearings; so that the divorce proceedings are delayed and remain inconclusive.
Currently, the bill provides various bases for closure of marriage by a ruling of divorce in the section 13 of the Hindu Marriage Act, 1955.
The basis include cruelty, adultery, desertion, opting some other religion, mind upset, and “not being heard as being alive” for more than seven years.
Similar conditions have been cited in the section 27 of the Special Marriage Act, 1954.

1. BEWARE - MAN OR WOMAN WHO INTENDS TO HARASS THEIR SPOUSE !
Good that our government realised it as many of the marital life is nipped into the bud before they flourish. Spouse who are intending to have their home set to fire would now be punished and the innocent ( he or she ) guy would feel much relaxed and can start their lives again happily.
It seems right to live is alive in india now. Hats off to the entire cabinet team.

2. Details of this law
I want to know this law in detail. What will happen if one party does not want to divorce but harass the first one...??? itz urgent
3. Divorce by mutual consent
Divorce by mutual consent is still going to be a big unresolved issue in newly ammended Hindu Marriage Law as one party may harass the other for not giving divorce even if the complainant doesn't want to live with partner.
